Our Terms and Conditions, Policies apply to purchases made from our online store www.Pakenhamappliances.com.au (website). It is required that you agree with these terms to use and purchase goods from our website.

Use of our website confirms you accept our Terms and are bound by them. These Terms are subject to change without notice. We recommend you review our terms and conditions before purchasing.

Agency Appliances

We have an agency agreement with Speedqueen.
When you purchase a Speedqueen appliance you are purchasing directly from the supplier. Prices for these appliances are set by suppliers. Appliances will usually be delivered directly from the supplier.

Australian consumer law

Our terms and conditions are not intended to exclude or limit any rights which you may have under the Competition and Consumer Act 2010. Australian Consumer Act will prevail in cases of inconsistency.

Placing orders

Orders can be placed online, over the phone and at our shop address. We reserve the right to accept or reject orders. Our services are reserved for persons over the age of (18) eighteen years old.

Prices and availability is subject to change without notice. Be sure to check for the latest prices on our website, these can be confirmed by our sales department. All orders placed through telephone or online checkout are the responsibility of the customer to check product and pricing information.

Orders will be processed once payment is finalised.
Spare parts – processing of order will follow with a parcel tracking email update when in transit.
New Appliances – processing of order will follow contact from our team to schedule pickup or delivery.

Availability

Our team works closely with manufacturers to keep stock level availability up to date on our website and instore. Availability of stock levels are subject to change without notice.
If an order is unable to be processed because availability has changed, our team will contact you to discuss options to remedy the issue.
Depending on the specific circumstances to the order we will offer to amend, cancel or backorder the order.

Price & Payment Methods

Prices are subject to change without notice. All prices are inclusive of GST.

We accept payment by MasterCard, VISA, PayPal.

We will not be held responsible for any loss or damage (direct or indirect) resulted by you if your credit card is fraudulently used or is used in an unauthorised manner by a third party.

Promotional Discounts can be entered at the checkout or applied over the phone. Each Promotional Discount has a specific set of terms and conditions valid at our discretion. Promotional Discounts cannot be used in conjunction with any other offer or discounts.

Upon delivery of your order a tax invoice will be given. Your tax invoice is needed for Warranty claims as a proof of purchase.

Delivery

We have a flat rate of $50.00 Delivery within our service area.
Delivery and Installation are offered within our service area (prices are listed in Shipping Policy). Outside our service area can be quoted over the phone or through email. Our team will schedule delivery through Monday – Friday.

When your order payment is confirmed, our team will contact you to schedule Delivery. Delivery date is dependent on availability in the work schedule and driver availability.Changes to the delivery date will need to be confirmed with a minimum of 48 hours of the scheduled delivery date. Failed attempts to deliver will incur a fee. If an order needs to be delivered in two separate deliveries this will not incur additional fees unless specified by our team. This is only applicable to Deliveries and not applicable to Delivery + Installation.

Delivery is fulfilled by our technicians, manufacturers and couriers. Deliveries must be signed for, depending on delivery fulfillment.

(We only sell to Victoria Australia market for new appliances) (Spare parts are available for sale across Australia)

Installation & Disposal Of Appliances

Installation & delivery has set rates detailed in the Installation Delivery Policy. These works are carried out by our trained technicians and is only offered to our service area unless approved by our team. We offer disposal of your old appliances. The old appliance should resemble a similar size to the new appliance replacing it.

Disposal of old appliances is only applicable to our service area and dependant on the type of delivery service used to fulfill delivery.

****Delivery + Installation rates cover the services we offer, each installation is subject to needing additional works from other trades depending on specific install requirements outside of normal scope of works.****

Title & Risk

If an title of an order is applicable when payment has been made in full and delivered, If for any reason payment is declined we reserve the right to reclaim the goods from your possession, custody or control even if delivery has been accepted. Loss of goods or damage to goods will pass on to you upon delivery.

Warranty & Limitations Of Liabilities

Warranties are specific to each manufacturer, proof of purchase is required to access warranty claims. Manufacturer Warranties vary depending on use for business or commercial settings.

Force Majeure

Pakenham Appliances will not be held liable for any delay or failure to perform our obligations under these Conditions of Sale if such delay is due to any circumstance beyond our reasonable control. We reserve the right to terminate our agreement.

Severability

If any part of these Terms are found to be void, invalid, unlawful or unenforceable then that provision or part will be deemed to be severed from these Terms and the remaining terms and provisions of these Terms will remain in force and constitute the agreement between you and Pakenham Appliances.

General Conditions

Our terms and conditions are subject to change without notice and your access to our website may be terminated at any time without notice. If your access to our website is terminated, all aspects of our policies and terms continue to be valid.
